What is changing in Vermont land use?

Vermont is gradually changing where new development is encouraged and where it faces more review. The state is steering more housing and growth toward village and town centers, while applying more scrutiny to rural and environmentally sensitive land.

This shift is happening through updates to Act 250 and the creation of new land classifications, including Tier 3.

What is Tier 3?

Tier 3 is a new land category under Vermont’s land-use system that applies to certain rural and natural areas the state considers especially important to protect.

Tier 3 areas may include:

  • Wildlife travel corridors
  • Headwater streams
  • Large, intact forest blocks
  • Sensitive natural areas

If land is designated Tier 3, larger or more impactful projects are more likely to trigger state review.

Does Tier 3 mean I can’t build on my land?

No.

Tier 3 does not ban building or automatically prevent development. It does mean that:

  • Projects may face more review
  • The process may take longer
  • Additional studies or documentation may be required

Small, single-family projects are often still possible, depending on location and design.

How do I know if my land is in Tier 3?

Tier 3 areas are identified through state mapping, which is still being refined.

If you’re unsure:

  • You can review state and regional planning maps
  • Or speak with a knowledgeable local professional before assuming anything

Mapping matters — but it is not always perfect, and context still counts.

Is this only about environmental protection?

No. Environmental protection is part of it, but not the whole story.

The changes are also driven by:

  • Repeated flooding and infrastructure damage
  • High costs of extending roads, sewer, and water
  • Vermont’s housing shortage
  • Climate and resilience planning

The goal is to focus growth where services already exist.

What are “growth centers” or Tier 1 areas?

These are villages, downtowns, and town centers with:

  • Existing sewer and water
  • Walkability
  • Roads and services

The state wants more housing built in these areas because it’s faster, cheaper, and easier to support long-term.

Does this override local zoning?

No — and this is important.

Even if the state encourages housing in town centers, local zoning rules still apply. Local Development Review Boards, parking rules, height limits, and neighborhood input still control what gets built.

This creates tension in some towns, and it’s still playing out.

Is Act 250 still a barrier to housing?

Less than it used to be.

Today, local zoning is often the bigger hurdle. Act 250 is being adjusted to better support infill housing, but town-level rules haven’t always caught up yet.

What does this mean for rural land values?

Over time:

  • Rural land may still hold strong scenic, recreational, and privacy value
  • But development value may grow more slowly
  • Subdivision and larger projects may become more expensive and uncertain

This won’t happen overnight — but it’s a long-term shift.

What does this mean for village and town centers?

You may see:

  • More proposals for apartments or mixed-use buildings
  • More debate about density, parking, and scale
  • Pressure on towns to allow housing they’ve historically resisted

How towns respond will shape their future character.

Why is this happening so quietly?

Because it’s being built through:

  • Planning meetings
  • Rulemaking
  • Mapping updates
  • Technical working groups

Most of this work happens through the Land Use Review Board and related agencies, not through headline legislation.

Should I be worried?

No — but you should be informed.

If you:

  • Own land
  • Plan to build
  • Expect to sell someday
  • Or are buying property in Vermont
